Privacy Statement

Derry Software, LLC,  (“us,” “we,” “our”, or “Derry Software”) values your privacy.  In this privacy policy (“Policy”), we describe the information we collect, how we use it, and when and with whom we may share it.  This policy applies to all our sites, mobile applications, and other online services (collectively, “Platform”) that are administered by Derry Software.   By accessing our platform, you agree to this Policy.  PLEASE DO NOT USE OR ACCESS OUR PLATFORM IF YOU DO NOT AGREE TO THIS POLICY.

Derry Software, LLC is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. This Privacy Statement applies to the Derry Software Service and governs data collection and usage. By using our websites and/or software services, you consent to the data practices described in this statement. Derry Software, LLC is not responsible for the privacy statements or other content on websites outside of the derrysoftware.com domain that may link to Derry Software, LLC pages or that may be linked to from Derry Software, LLC pages.

Information We Collect

Derry Software, LLC collects personally identifiable information, such as your email address, name, home or work address, or telephone number, as well as anonymous demographic information that is not unique to you, such as your general geographic location (e.g., by country or state), agency, or organization. Derry Software, LLC also automatically collects usage statistics for various functions in our websites and/or software services, as well as information about your computer hardware and software, including, but not limited to, your IP address, browser type, domain names, access times and durations, and referring website addresses. Derry Software, LLC uses this information for the operation of our websites and/or software services, to maintain the quality of our websites and/or software services, and to provide for general statistical analysis regarding use of our websites and/or software services.

We collect and store information using multiple methods when you provide information directly to us, when you permit third parties to provide information to us, and when we may passively collect information from your browser or mobile device. We collect this information from you during access to our platform in different activities such as when you register for an account, participate in a pool survey, or blog post comment, enroll for electronic newsletters, request a quote or informaiton, submit or respond to a quote, make a purchase, fill out any form, register for a promotion, transmit user content, download or use one of our applications, or otherwise communicate wit us or one of our users through our Platform.  This list of activities is not exhaustive and may include others.

Security of Your Information

Security of Data, Including your Personally Identifiable Information. Derry Software secures your personally identifiable information from unauthorized access, use, or disclosure. Such data is stored in a secure cloud computing environment, on computer servers or computer-based storage subsystems (e.g., Storage Area Networks; SANs), in a controlled, secure environment, protected from unauthorized access, use, or disclosure.

Use of your Personally Identifiable Information

Derry Software, LLC collects and uses your personally identifiable information to operate our websites and/or software services and to deliver the functionality to which you have requested access for other services or information.  Derry Software, LLC may also use your personally identifiable information, from time to time, to inform you of other products or services available from or through Derry Software, LLC. Derry Software, LLC may also contact you via surveys to conduct research about your opinion of the Derry Software service or of potential new services that may be offered. In the event that you are contacted for any of the foregoing reasons, you will be offered the opportunity to opt out of future contacts of the same nature.

Derry Software, LLC does not sell, rent, or lease its customer lists, including personally identifiable information, to third parties. Derry Software, LLC will disclose your personal information, without notice, to lawfully authorized recipients, only if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on Derry Software, LLC, (b) protect and defend the rights or property of Derry Software, LLC, and (c) act under exigent circumstances to protect the personal safety of users of Service or of the public.

Derry Software, LLC may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personally identifiable information except to provide these services to Derry Software, LLC, and they are required to maintain the confidentiality of your information.

Use of Cookies

Our websites and/or software services may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your computer’s local hard disk by a web server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. For example, if you personalize pages, or register with the site or Service, a cookie helps Derry Software, LLC to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same Derry Software, LLC site, the information you previously provided can be retrieved, so you can easily use the Derry Software, LLC features that you customized. You can accept or decline cookies. If you choose to decline cookies, you may not be able to experience all of the features offered by MSAT.

Indemnification

By using our Platform, you agree to hold harmless and indemnify Derry Software, LLC against any and all claims and actions arising or resulting from your use of it, including, without limitation, expenses, judgements, fines, settlements, and other amounts actually and reasonably incurred in connection with any liability, suit, action, loss, or damage arising or resulting from your use of our Platform.

Governing Law

This Policy is governed by and construed in accordance with the laws of the State of Tennessee without regard to its conflicts of law’s provisions. In the event of a dispute, the user agrees to first negotiate and mediate the dispute. If such efforts are unsuccessful within 90 days of written notice of the dispute, as a last resort, the user agrees to submit exclusively to the jurisdiction of the federal and state courts of the State of Tennessee, and further agrees that any and all legal actions arising therefrom shall take place in such courts.

Updates to this Agreement

Derry Software, LLC will occasionally update this Privacy Policy and reserves the right to make such updates at any time, in whole or in part, without prior notice to users of our Platform. Derry Software, LLC, encourages you to periodically review this Agreement to be informed of updates. By continuing to access or use our Platform after this Agreement has been updated, you agree to be bound by the terms of the updated Agreement. If you do not agree to the updated Agreement, you may no longer use our Platform or services.
